GUEST RENTAL AGREEMENT

Top of the Ridge makes this agreement between Top of the Ridge and guest to rent the premises under the terms listed.  You must sign and return a copy of these rules within 1 week for the reservation to be confirmed. 

 

RESERVATIONS

All reservations require a 50% deposit.  There is a two-night minimum.  There may be a different minimum stay requirement during the ski season.   A credit card is not necessary for booking, however, if making payment by check, the deposit check must be received within 1 week of booking and balance must be received 30 days prior to arrival date.  Payments are accepted by check, credit cards, or Paypal.   A fee of $35.00 will be charged on all returned checks. 

 

The balance due will be required at least 30 days prior to arrival.  You must be 25 years of age to make a reservation.  Proof of age is required.   Violation of this policy will result in immediate eviction without refund of rent.

 

Upon receipt of deposit payment and signed rental agreement, the reservation will be confirmed via email or regular mail.  Rates do not include 6% West Virginia state sales and 6% Pocahontas county lodging tax which is in addition to the rental rate.  The published rates are based on an occupancy of 10-12 persons. 

 

Upon receipt of the final payment, instructions, detailed directions, key lock box code, and a separate key will be mailed to you.  There are two keys in the lock box at the front door and you will also have a separate key.   This separate key must be returned and your security deposit will be returned.

 

CANCELLATIONS       

If your reservation is cancelled for any reason, you will be charged a non-refundable $50.00 fee plus any credit card processing charges (no more than 3% of amount charged).  If you cancel with more than 30 days prior to arrival, you will receive a full refund, less a $50.00 cancellation fee plus any credit card processing charges (no more than 3% of amount charged).  If you cancel less than 30 days prior to arrival, you will forfeit your deposit (unless the house is re-rented for the same time period and for an equal or greater amount) in which case you will receive a refund, less any difference in rental value and a $50.00 cancellation fee plus any credit processing charges (no more than 3% of amount charged).  Guests are responsible for all nights reserved regardless of late arrival or early departure.  There are NO refunds for “NO-SHOW”.  Top of the Ridge is not responsible for acts of God.  Conditions which Top of the Ridge cannot control (i.e. weather, temperature, rain, snow, etc.) are not considered grounds for a refund.

 

CHECK IN/CHECK OUT TIMES

Check-in time is 4:00 p.m.  Check-out time is 11:00 a.m.  A packet with a key, map and information will be mailed to you upon receipt of the deposit.  PLEASE NOTE: 4-WHEEL DRIVE OR CHAINS ARE ABSOLUTELY NECESSARY DURING WINTER MONTHS TO GET TO THE TOP OF THE RIDGE.  THE 2 MILE RIDGE ROAD IS PLOWED AFTER EVERY 3 INCHES OF SNOW, HOWEVER PACKED SNOW REMAINS IN THE SHADY AREAS AND THE ROAD IS A CLIMBING WINDING ROAD.

 

SECURITY DEPOSIT

A Security Deposit is an additional amount above the rental amount and is required for all rentals in the amount of $300 and is due with your second and final payment.   The Security Deposit can be made by check or by providing a credit card number.  During the ski season, credit cards are the only accepted method of providing a Security Deposit.  The security deposit will be returned after 1. The key is returned and 2. Verification that there are no missing items, no damages, or excessive cleaning required, or additional telephone, or pay per view charges incurred. If you break the terms of the lease, you stand to lose the entire Security Deposit as well as to be charged for any damages beyond normal wear and tear resulting during your stay.

 

ACCOMMODATIONS

Supplies and Appliances: Top of the Ridge comes with a fully-equipped kitchen, washer/dryer, satellite TV, telephone and completely furnished unless otherwise stated.   Soap, dish washer detergent, trash bags and toilet paper are provided.

 

Top of the Ridge is privately owned and you are renting directly from the owner.  Misrepresentation is unintentional.  Top of the Ridge comes equipped with the basic necessities when renting a home. 

 

CLEANING

The Top of the Ridge will be cleaned before and after each reservation.  Please leave the unit as clean as you found it.  Remove all perishable food items from the refrigerators.  All furniture and items should be returned to their original location.  Do not make beds that have been slept in and strip all slept in beds and leave linens and towels in a pile near the front door.  Excessive cleaning will be charged against your deposit at $25/hour with a one-hour minimum.  Excessive cleaning is considered anything beyond changing bed linens, laundering linens, dusting, vacuuming, cleaning the bathroom(s) and putting away clean dishes.

 

TRASH

Place all trash in trash cans outside of the garage.  Housekeeping will remove the trash when the house is cleaned.  Please use the trash compactor whenever possible to make the removal of trash from the ridge top easier.

 

HOT TUB

The hot tub is to be used at your own risk.  Close the lid after every use to keep the water hot and when no one in your party is supervising.  It is cleaned after every departure and prepared for the next arrival. The guests will be responsible for adding additional shock or chlorine granules per the instructions at the property. 

 

WATER

The Top of the Ridge is on a well and septic system due to the remote location and supplemented with rain water in the summer.   The water system is fully filtered and sterilized through an UltraViolet cleansing mechanism and is tested regularly.  Due to possible changes in the ground water supply that are beyond our control, we recommend bringing bottled drinking water.  For your convenience, every attempt is made to keep 5 gallon spring water bottles available and installed in the water dispenser.

 

MAXIMUM OCCUPANCY

The number of guests occupying is limited to 12 with the exception of infants sleeping in cribs or playpens.  These limits are important due to water limitations and bed capacity.  Exceeding maximum occupancy, except where specifically authorized, will be grounds for immediate eviction and forfeiture of all funds paid.

SMOKING IS NOT ALLOWED ON THE PROPERTY

 

PETS

Top of the Ridge is a ‘Pet-friendly’ rental.  If guest has been granted permission to bring a pet, a per pet fee of $50 will be charged and an additional $250 refundable deposit is required for each pet.  PETS ARE NOT ALLOWED ON ANY FURNITURE OR BEDS!  Any additional cleaning or repairs/replacement of furnishings required due to occupancy of the pet will be charged against the pet deposit.  Additional charges may apply if pet feces is not properly cleaned up and disposed.  If it is found that there are more or different pets than agreed to on the premises, or if complaints come from neighbors about excessive noise due to the pets, guest will be asked to vacate immediately with no refund. 

 

PHONES/LONG DISTANCE CALLS

Top of the Ridge has local phone service only.  Long Distance calls must be placed on guest’s calling card or credit card.  Any calls billed directly to the property will be charged to the guest’s credit card including a $15.00 service charge.  Many cell phones will work from the Top of the Ridge because of its location, however, cell phones generally do not work in the valley.  Calling cards are available at the Exxon/Mobile mart at the base of the mountain.

 

DSL INTERNET

Top of the Ridge has a wired and wireless DSL connection that is available for your use.

 

TV/VCR/SATELLITE

Top of the Ridge is equipped with satellite TV with local channels.  Some rooms are equipped with a VCR and some are equipped with a DVD player in addition to satellite and/or in place of satellite TV.

 

LOST/NON-RETURNED KEYS

The separate key mailed to you must be returned after leaving the property and your security deposit will be returned.  Leave 2 keys in the key lock box.  Please mail the separate key to :

  • Guests are responsible for lost keys and the property will be re-keyed in the event that keys are lost, misplaced or not returned.  All associated costs will charged against your deposit.

 

UNIT CHANGES

While every effort is made to accommodate guests in the Top of the Ridge, however, if the property were to become unavailable, every effort will be made to arrange accommodations with another property through one of the local property management companies near Snowshoe.  Rates may vary and Top of the Ridge’s liability shall be limited to refund of any deposit.

 

REPAIRS

Unfortunately we cannot guarantee the operation of all appliances and amenities.  Please report inoperative equipment to us.  We will make every effort to have repairs made as quickly as possible however, due to the location, it is sometimes difficult to arrange for immediate resolution.  These failures are beyond our control and no refund or rent reduction will be given.

 

RISKS/SAFETY

Children are welcome, however, there may be conditions in and around the unit that may pose a hazard to them as well as to adults.  Top of the Ridge does not assume any liability or responsibility for any injuries occurring during your stay with us.  Children must be supervised at all times.

INDEMNIFICATION

The guest agrees to indemnify and hold individual homeowner, Top of the Ridge and it employees or agents, free and harmless for any liabilities or any loss or damages whatsoever arising from, related to, or in connection with rental of premises.  This includes, but is not limited to, any claim or liability for personal injury or damage or loss of property, which is made, incurred or sustained, by guest or guest of guest, or any occupant’s of the premises.

TERMINATION OF RENTAL

Top of the Ridge reserves the right to refuse or discontinue tenancy if in its opinion the guest is detrimental to the property.  Any violation of the above-mentioned policies will result in immediate eviction and loss of entire rental and deposit amounts.

 

CREDIT CARD AGREEMENT

I am providing my credit card number as a guarantee of payment to Top of the Ridge. I agree to pay all rent and charges related to property rental. I accept all terms of the lease agreement and accept all liability for rent and charges related to property rental, as well as any damage beyond normal wear and tear during my stay.  I understand that these costs will be charged to my credit card, in the absence of another payment arrangement, I authorize Top of the Ridge to charge my credit card for payment of these items.

 

AGREEMENT

Guest certifies that he/she has read and agrees to abide by the terms of this rental agreement and by signing below is authorizing any outstanding charges remaining after departure will be charged against the credit card on file or deducted from the Security Deposit provided to Top of the Ridge.
